Bu koşullar, Global Dijital ("PadConsole", "biz") tarafından sunulan padconsole.com web hizmeti, PadConsole mobil uygulaması ve bunlara bağlı tüm oyun ve sunucu hizmetlerinin ("Hizmet") kullanımını düzenler. Hizmeti kullanarak bu koşulları kabul etmiş olursunuz.

1. Hizmetin Tanımı

PadConsole, telefonunuzu bir oyun kumandasına dönüştüren ve aynı ekranda çok oyunculu oyunlar oynamanızı sağlayan bir platformdur. Hizmetin temel kullanımı ücretsizdir ve reklam içermez. İsteğe bağlı PadConsole Premium aboneliği 15. bölümde açıklanır.

2. Uygunluk ve Yaş

• Hizmet 4 yaş ve üzeri için uygun içerik derecelendirmesine sahiptir.
• 13 yaşından küçükseniz Hizmeti yalnızca ebeveyn veya vasinizin bilgisi ve gözetimi altında kullanmalısınız.
• Sözleşme kurma ehliyetiniz yoksa, Hizmeti kullanımınız yasal temsilcinizin onayına tabidir.

3. Hesaplar

Çevrim içi kalıcı dünya modunda otomatik olarak anonim bir misafir hesabı oluşturulur. Kayıt formu doldurmanız gerekmez. Hesap, cihazınızda saklanan bir yenileme anahtarına bağlıdır; cihazı kaybetmeniz, uygulama verilerini silmeniz veya tarayıcı verilerini temizlemeniz hâlinde hesaba erişiminizi kalıcı olarak kaybedebilirsiniz. Bu durumda ilerlemenizi geri getiremeyiz.

Telefon kumandasında Google, Apple veya e-posta koduyla isteğe bağlı bir PadConsole hesabı açabilirsiniz. Bu hesap hiçbir oyuna veya oda bağlantısına erişmek için zorunlu değildir. Doğru ve size ait bir giriş yöntemi kullanmaktan, erişim bilgilerinizi korumaktan ve hesabınız üzerinden yapılan işlemlerden siz sorumlusunuz. Hesabı Ayarlar bölümünden kalıcı olarak silebilirsiniz. 13 yaşından küçükler isteğe bağlı hesap açamaz.

4. Kabul Edilebilir Kullanım

Hizmeti kullanırken aşağıdakileri yapmamayı kabul edersiniz:

• Yürürlükteki mevzuata aykırı davranmak veya üçüncü kişilerin haklarını ihlal etmek
• Hizmete, sunucularımıza veya diğer kullanıcılara zarar verecek şekilde müdahale etmek; aşırı yük oluşturmak, otomatik istek üretmek veya hız sınırlarını aşmaya çalışmak
• Oyun istemcisini veya ağ trafiğini değiştirerek hile yapmak, sunucu doğrulamalarını atlatmaya çalışmak, açık istismar etmek
• Hizmeti tersine mühendisliğe tabi tutmak, kaynak kodunu türetmek veya kopyalamak
• Başka bir kullanıcıyı taciz etmek, tehdit etmek veya rahatsız edici içerik iletmek
• Hizmeti ticari olarak yeniden satmak veya izinsiz olarak yeniden yayınlamak

Bu kuralları ihlal eden hesapların erişimini uyarı yapmaksızın askıya alabilir veya sonlandırabiliriz.

5. Oyun İçi Varlıklar

Oyun içi bakiye, envanter ve benzeri sanal varlıkların gerçek para değeri yoktur; satın alınamaz, satılamaz, devredilemez ve nakde çevrilemez. Bunlar Hizmet dâhilinde size tanınmış, kişisel ve devredilemez bir kullanım hakkıdır. Oyun dengesi gereği bu varlıkları değiştirebilir, sıfırlayabilir veya kaldırabiliriz.

6. Fikri Mülkiyet

PadConsole markası, logosu, arayüzü, oyun içerikleri, grafikleri, ses varlıkları ve yazılımı Global Dijital'e veya lisans verenlerine aittir ve telif hakkı mevzuatı ile korunur. Bu koşullar kapsamında size yalnızca Hizmeti kişisel ve ticari olmayan amaçlarla kullanmanız için sınırlı, münhasır olmayan, devredilemez bir lisans verilir.

Hizmet, üçüncü taraf açık kaynak bileşenler içerebilir; bunlar kendi lisans koşullarına tabidir.

7. Ağ ve Cihaz Gereksinimleri

Hizmet, telefon ile ekran cihazının aynı yerel ağda ve doğrudan (P2P) bağlantı kurabildiği varsayımıyla çalışır. İnternet bağlantınız, ağ yapılandırmanız, güvenlik duvarınız veya cihaz performansınız kaynaklı sorunlardan sorumlu değiliz. Veri kullanımı ve olası operatör ücretleri size aittir.

8. Hizmetin Sürekliliği ve Değişiklikler

Hizmeti dilediğimiz zaman güncelleyebilir, özellik ekleyebilir veya kaldırabilir, bakım nedeniyle geçici olarak durdurabiliriz. Hizmet "olduğu gibi" ve "mevcut olduğu şekliyle" sunulur; kesintisiz veya hatasız çalışacağı garanti edilmez.

9. Garanti Reddi ve Sorumluluğun Sınırlandırılması

Yürürlükteki mevzuatın izin verdiği azami ölçüde, Hizmete ilişkin açık veya zımni tüm garantiler reddedilir. Dolaylı, arızi, özel veya sonuç niteliğindeki zararlardan; veri kaybı, kâr kaybı veya oyun ilerlemesinin kaybından sorumlu değiliz.

Bu madde, tüketici mevzuatından doğan ve sözleşmeyle sınırlandırılamayan haklarınızı etkilemez.

10. Fesih

Hizmeti dilediğiniz zaman uygulamayı kaldırarak kullanmayı bırakabilirsiniz. Hesabınızın ve verilerinizin silinmesi için Hesap ve Veri Silme adımlarını izleyin. Bu koşulları ihlal etmeniz hâlinde erişiminizi sonlandırabiliriz.

11. Gizlilik

Kişisel verilerinizin işlenmesi Gizlilik Politikası ve KVKK Aydınlatma Metni ile düzenlenir. Bu belgeler bu koşulların ayrılmaz parçasıdır.

12. Uygulanacak Hukuk ve Yetki

Bu koşullara Türkiye Cumhuriyeti hukuku uygulanır. Uyuşmazlıklarda İzmir Mahkemeleri ve İcra Daireleri yetkilidir. Tüketici sıfatı taşıyan kullanıcılar, parasal sınırlara göre yerleşim yerlerindeki Tüketici Hakem Heyetlerine veya Tüketici Mahkemelerine başvurabilir.

13. Değişiklikler ve İletişim

Bu koşulları güncellediğimizde bu sayfadaki tarihi değiştirir, esaslı değişikliklerde uygulama içinde bilgilendirme yaparız. Sorularınız için: destek@padconsole.com

14. PadConsole Yayın Masası

Yayın Masası, yetkili PadConsole yöneticilerinin kendi sosyal medya hesaplarına video yüklemesi ve paylaşım sonuçlarını izlemesi için kullanılan bir yönetim aracıdır. Oyun ve kumanda kullanımına verilen kişisel kullanım lisansından ayrı olarak, yetkili yöneticiler aracı PadConsole'un kendi hesaplarını yönetmek amacıyla kullanabilir.

Yönetici yalnızca sahibi olduğu veya yönetme yetkisi bulunan hesapları bağlamalıdır. Videoların, müziğin ve metinlerin kullanım hakları, ilgili kişilerin gerekli izinleri, doğru hedef hesap ve açıklama seçimi ile her platformun içerik ve paylaşım kurallarına uyum yöneticinin sorumluluğundadır.

“Tek tıkla paylaş” işlemi seçilen hedefler için API yüklemesini başlatabilir veya agent görevi oluşturabilir. API ve AI agent yollarının kullanılabilirliği platform izinlerine ve açık tarayıcı oturumlarına bağlıdır. Agent görevini ilgili hizmete veren yönetici, görevin içerik ve hedeflerini kontrol etmelidir. Bir hedefte başarısızlık diğer hedeflerde tamamlanmış paylaşımı geri almaz. Taslak veya özel görünürlük kısıtları uygulanabilir; herkese açık yayın veya istatistiklerin kesintisiz ve tam alınması garanti edilmez.

Bir gönderiyi panelden silmek sosyal platformdan kaldırmaz. Platformda paylaşılmış içeriği kaldırmak için ilgili platform kullanılmalıdır. Hesap erişimi ve bilgisayarın korunması yöneticinin sorumluluğundadır. Verilerin işlenmesi Gizlilik Politikası'ndaki Yayın Masası bölümüyle açıklanır. 15. PadConsole Premium Aboneliği

• PadConsole Premium, aylık (Premium Monthly) ve yıllık (Premium Yearly) seçenekleri olan, otomatik yenilenen isteğe bağlı bir aboneliktir. Güncel fiyat, satın almadan önce uygulamada ve mağazada yerel para biriminizle gösterilir.
• Ödeme, satın alma onaylandığında Apple ID veya Google Play hesabınızdan alınır.
• Abonelik, mevcut dönemin bitiminden en az 24 saat önce iptal edilmezse aynı süre ve fiyatla otomatik olarak yenilenir; yenileme ücreti dönem bitmeden önceki 24 saat içinde tahsil edilir.
• Aboneliği satın aldıktan sonra cihazınızın hesap ayarlarından (App Store: Ayarlar > Apple ID > Abonelikler; Google Play: Ödemeler ve abonelikler) yönetebilir veya iptal edebilirsiniz. İptal, mevcut dönemin sonunda geçerli olur.
• İadeler ilgili mağazanın (Apple veya Google) politikalarına tabidir.
• App Store üzerinden yapılan satın alımlarda bu koşullara ek olarak Apple'ın standart Lisanslı Uygulama Son Kullanıcı Lisans Sözleşmesi (EULA) geçerlidir: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

Diese Bedingungen regeln die Nutzung des Webdienstes padconsole.com, der mobilen PadConsole-App sowie aller zugehörigen Spiele und Serverdienste („Dienst“), betrieben von Global Dijital („PadConsole“, „wir“). Mit der Nutzung akzeptieren Sie diese Bedingungen.

1. Der Dienst

PadConsole macht Ihr Telefon zum Controller für lokale Mehrspieler-Spiele auf einem gemeinsamen Bildschirm. Die Grundnutzung des Dienstes ist kostenlos und werbefrei. Das optionale Abonnement PadConsole Premium ist in Abschnitt 15 beschrieben.

2. Berechtigung und Alter

• Der Dienst ist inhaltlich ab 4 Jahren geeignet.
• Unter 13-Jährige sollen ihn nur mit Wissen und Aufsicht eines Elternteils oder Erziehungsberechtigten nutzen.
• Wer nicht vertragsfähig ist, benötigt die Zustimmung seiner gesetzlichen Vertretung.

3. Konten

Der dauerhafte Online-Modus erstellt automatisch ein anonymes Gastkonto. Es ist an ein Aktualisierungstoken auf Ihrem Gerät gebunden. Bei Geräteverlust, Löschen von App-Daten oder Browserspeicher kann der Zugang samt Fortschritt dauerhaft verloren gehen und nicht wiederhergestellt werden.

Optional kann im Telefon-Controller mit Google, Apple oder E-Mail-Code ein PadConsole-Konto erstellt werden. Ein Konto ist nie nötig, um einem Raum beizutreten oder zu spielen. Sie sind für Ihre Anmeldemethode, deren Schutz und Kontoaktivitäten verantwortlich. Das Konto kann in den Einstellungen dauerhaft gelöscht werden. Unter 13-Jährige dürfen kein optionales Konto erstellen.

4. Zulässige Nutzung

Sie verpflichten sich, Folgendes zu unterlassen:

• Gesetze oder Rechte anderer verletzen
• Dienst, Server oder Nutzer stören, übermäßige Last erzeugen, Anfragen automatisieren oder Begrenzungen umgehen
• Durch Client-/Netzwerkmanipulation betrügen, Serverprüfung umgehen oder Schwachstellen ausnutzen
• Den Dienst zurückentwickeln, Quellcode ableiten oder kopieren
• Andere belästigen, bedrohen oder beleidigende Inhalte senden
• Den Dienst ohne Erlaubnis kommerziell weiterverkaufen oder erneut veröffentlichen

Konten, die diese Regeln verletzen, können ohne Vorankündigung gesperrt oder beendet werden.

5. Virtuelle Gegenstände

Guthaben, Inventar und ähnliche virtuelle Gegenstände haben keinen Geldwert und können nicht gekauft, verkauft, übertragen oder ausgezahlt werden. Sie sind eine persönliche, nicht übertragbare Nutzungslizenz innerhalb des Dienstes und können aus Gründen der Spielbalance geändert, zurückgesetzt oder entfernt werden.

6. Geistiges Eigentum

Name, Logo, Oberfläche, Spielinhalte, Grafiken, Audio und Software gehören Global Dijital oder Lizenzgebern und sind urheberrechtlich geschützt. Sie erhalten nur eine beschränkte, nicht ausschließliche, nicht übertragbare Lizenz zur persönlichen, nicht kommerziellen Nutzung. Open-Source-Komponenten bleiben ihren eigenen Lizenzen unterworfen.

7. Netzwerk- und Geräteanforderungen

Telefon und Bildschirmgerät müssen sich grundsätzlich im selben lokalen Netz befinden und eine direkte P2P-Verbindung herstellen können. Für Probleme durch Internet, Netzwerkkonfiguration, Firewall oder Geräteleistung sowie Daten- und Mobilfunkkosten sind wir nicht verantwortlich.

8. Verfügbarkeit und Änderungen

Wir können den Dienst aktualisieren, Funktionen hinzufügen oder entfernen oder ihn für Wartung unterbrechen. Er wird „wie besehen“ und „wie verfügbar“ ohne Garantie eines ununterbrochenen oder fehlerfreien Betriebs bereitgestellt.

9. Gewährleistungs- und Haftungsbeschränkung

Soweit gesetzlich zulässig, schließen wir ausdrückliche und stillschweigende Gewährleistungen aus. Wir haften nicht für mittelbare, zufällige, besondere oder Folgeschäden oder für Verlust von Daten, Gewinn oder Spielfortschritt. Unabdingbare Verbraucherrechte bleiben unberührt.

10. Beendigung

Sie können die Nutzung jederzeit durch Deinstallation beenden. Zur Löschung von Konto und Daten folgen Sie der Anleitung zur Konto- und Datenlöschung. Bei Verstoß gegen diese Bedingungen können wir den Zugang beenden.

11. Datenschutz

Die Verarbeitung personenbezogener Daten richtet sich nach der Datenschutzerklärung und dem KVKK-Datenschutzhinweis, die Bestandteil dieser Bedingungen sind.

12. Anwendbares Recht und Gerichtsstand

Es gilt das Recht der Republik Türkiye. Zuständig sind Gerichte und Vollstreckungsbehörden in İzmir. Verbraucher können entsprechend den geltenden Wertgrenzen auch Verbraucherschlichtungsstellen oder Verbrauchergerichte an ihrem Wohnort anrufen.

14. PadConsole Publishing Desk (Yayın Masası)

Publishing Desk (Yayın Masası) ist ein Verwaltungswerkzeug für autorisierte PadConsole-Administratoren, um Videos auf ihren eigenen Social-Media-Konten hochzuladen und Veröffentlichungsergebnisse zu verfolgen. Unabhängig von der persönlichen Nutzungslizenz für Spiele und Controller dürfen autorisierte Administratoren das Werkzeug zur Verwaltung der eigenen PadConsole-Konten verwenden.

Administratoren dürfen nur Konten verbinden, die ihnen gehören oder die sie verwalten dürfen. Sie sind für die Rechte an Videos, Musik und Texten, notwendige Einwilligungen beteiligter Personen, korrekte Zielkonten und Beschreibungen sowie die Einhaltung der Inhalts- und Veröffentlichungsregeln jeder Plattform verantwortlich.

Die Veröffentlichungsaktion kann für die ausgewählten Ziele einen API-Upload starten oder einen Agent-Auftrag erstellen. Die Verfügbarkeit von API und KI-Agent hängt von Plattformberechtigungen und aktiven Browsersitzungen ab. Administratoren müssen Inhalt und Ziele prüfen, bevor sie einen Auftrag an einen Agent-Dienst übergeben. Ein Fehler bei einem Ziel macht eine abgeschlossene Veröffentlichung bei einem anderen Ziel nicht rückgängig. Entwurfs- oder private Sichtbarkeitsbeschränkungen können gelten. Eine öffentliche Veröffentlichung und ein vollständiger, ununterbrochener Statistikabruf werden nicht garantiert.

Das Löschen eines Beitrags im Panel entfernt ihn nicht von einer sozialen Plattform. Veröffentlichte Inhalte müssen auf dieser Plattform entfernt werden. Administratoren sind für den Schutz des Kontozugriffs und des Computers verantwortlich. Die Datenverarbeitung wird im Publishing-Desk-Abschnitt der Datenschutzerklärung beschrieben. Unterstützung ist unter destek@padconsole.com erreichbar.

15. Abonnement PadConsole Premium

• PadConsole Premium ist ein optionales, sich automatisch verlängerndes Abonnement als Premium Monthly und Premium Yearly. Der aktuelle Preis wird vor dem Kauf in der App und im Store in Ihrer Landeswährung angezeigt.
• Die Zahlung wird bei Kaufbestätigung über Ihre Apple-ID bzw. Ihr Google-Play-Konto abgerechnet.
• Das Abonnement verlängert sich automatisch zum gleichen Zeitraum und Preis, sofern es nicht mindestens 24 Stunden vor Ende des laufenden Zeitraums gekündigt wird; die Verlängerung wird innerhalb der 24 Stunden vor Ablauf berechnet.
• Sie können das Abonnement nach dem Kauf in den Kontoeinstellungen Ihres Geräts verwalten oder kündigen (App Store: Einstellungen > Apple-ID > Abonnements; Google Play: Zahlungen und Abos). Die Kündigung wird zum Ende des laufenden Zeitraums wirksam.
• Erstattungen richten sich nach den Richtlinien des jeweiligen Stores (Apple oder Google).
• Für Käufe über den App Store gilt zusätzlich zu diesen Bedingungen Apples Standard-Endbenutzer-Lizenzvertrag (EULA): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

Terms of Service

These terms govern your use of the padconsole.com web service, the PadConsole mobile application and all related games and server services (the "Service"), operated by Global Dijital ("PadConsole", "we"). By using the Service you accept these terms.

1. The Service

PadConsole is a platform that turns your phone into a game controller so you can play local multiplayer games on a shared screen. Core use of the Service is free and contains no advertising. The optional PadConsole Premium subscription is described in section 15.

2. Eligibility and Age

• The Service carries a content rating suitable for ages 4 and up.
• If you are under 13, you should use the Service only with the knowledge and supervision of a parent or guardian.
• If you lack capacity to enter into a contract, your use is subject to your legal representative's approval.

3. Accounts

The persistent online mode automatically creates an anonymous guest account. No sign-up form is required. The account is bound to a refresh token stored on your device; if you lose the device, clear app data or clear browser storage, you may permanently lose access to the account. We cannot restore progress in that case.

On the phone controller you may optionally create a PadConsole account with Google, Apple, or an email code. An account is never required to join a room or play. You are responsible for using a sign-in method that belongs to you, protecting access to it, and activity through your account. You can permanently delete the account in Settings. Users under 13 must not create an optional account.

4. Acceptable Use

You agree not to:

• Break applicable law or infringe the rights of others
• Interfere with the Service, our servers or other users; generate excessive load, automate requests or attempt to bypass rate limits
• Cheat by modifying the game client or network traffic, attempt to bypass server validation, or exploit vulnerabilities
• Reverse engineer, derive source code from, or copy the Service
• Harass, threaten or send offensive content to other users
• Resell or republish the Service commercially without permission

We may suspend or terminate access for accounts that violate these rules, without prior notice.

5. Virtual Items

In-game balances, inventory and similar virtual items have no real-money value; they cannot be bought, sold, transferred or cashed out. They are a personal, non-transferable licence to use them within the Service. We may change, reset or remove them for game-balance reasons.

6. Intellectual Property

The PadConsole name, logo, interface, game content, graphics, audio assets and software belong to Global Dijital or its licensors and are protected by copyright law. These terms grant you a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes only.

The Service may include third-party open-source components, which remain subject to their own licences.

7. Network and Device Requirements

The Service assumes the phone and the screen device are on the same local network and can establish a direct (P2P) connection. We are not responsible for problems caused by your internet connection, network configuration, firewall or device performance. Data usage and any carrier charges are yours.

8. Availability and Changes

We may update the Service, add or remove features, or pause it temporarily for maintenance at any time. The Service is provided "as is" and "as available", without a guarantee of uninterrupted or error-free operation.

9. Disclaimer and Limitation of Liability

To the maximum extent permitted by applicable law, all express or implied warranties relating to the Service are disclaimed. We are not liable for indirect, incidental, special or consequential damages, nor for loss of data, profit or game progress.

This clause does not affect consumer rights that cannot be limited by contract.

10. Termination

You may stop using the Service at any time by uninstalling the app. To delete your account and data, follow Account & Data Deletion. We may terminate your access if you breach these terms.

11. Privacy

Processing of your personal data is governed by the Privacy Policy and the KVKK Disclosure Notice, which form an integral part of these terms.

12. Governing Law and Jurisdiction

These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of İzmir have jurisdiction. Users acting as consumers may also apply to the Consumer Arbitration Committees or Consumer Courts at their place of residence, according to the applicable monetary thresholds.

13. Changes and Contact

When we update these terms we change the date on this page and, for material changes, notify you inside the application. Questions: destek@padconsole.com

14. PadConsole Publishing Desk (Yayın Masası)

Publishing Desk is an administration tool for authorized PadConsole administrators to upload videos to their own social media accounts and monitor publishing results. Separately from the personal-use licence for games and controllers, authorized administrators may use the tool to manage PadConsole's own accounts.

Administrators must connect only accounts they own or are authorized to manage. They are responsible for rights to videos, music and text, any necessary permissions from people involved, correct target accounts and descriptions, and compliance with each platform's content and publishing rules.

The publishing action may start an API upload or create an agent task for the selected targets. API and AI agent availability depends on platform permissions and active browser sessions. Administrators must check the content and targets before giving a task to an agent service. Failure at one target does not undo completed publishing at another. Draft or private visibility restrictions may apply. Public publishing and complete, uninterrupted statistics retrieval are not guaranteed.

Deleting a panel post does not remove it from a social platform; published content must be removed on that platform. Administrators are responsible for protecting account access and the computer running the tool. Data processing is described in the Publishing Desk section of the Privacy Policy. 15. PadConsole Premium Subscription

• PadConsole Premium is an optional auto-renewable subscription offered as Premium Monthly and Premium Yearly. The current price is shown in your local currency in the app and in the store before purchase.
• Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• The subscription renews automatically for the same period and price unless it is cancelled at least 24 hours before the end of the current period; the renewal is charged within the 24 hours before the period ends.
• You can manage or cancel the subscription in your device's account settings after purchase (App Store: Settings > Apple ID > Subscriptions; Google Play: Payments & subscriptions). Cancellation takes effect at the end of the current period.
• Refunds are subject to the policies of the relevant store (Apple or Google).
• For purchases made through the App Store, Apple's standard Licensed Application End User License Agreement (EULA) also applies in addition to these terms: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
